Terms of Service

Welcome to CAPAB. These Terms of Service ("Terms") govern your use of the CAPAB mobile application and related services (the "Service") provided by FULL MARKET LLC ("CAPAB," "we," "us," or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use CAPAB. By using the Service you represent and warrant that you meet these requirements.

2. The Service

CAPAB is a marketplace platform that connects independent workers ("Workers") with individuals or businesses seeking services ("Clients"). CAPAB is not an employer. Workers are independent contractors, not employees of CAPAB. We do not control how Workers perform their services.

3. Accounts

You must provide accurate information when creating your account.
You are responsible for keeping your account credentials secure.
You are responsible for all activity under your account.
One person, one account. Duplicate or fraudulent accounts will be terminated.

4. Acceptable Use

You agree NOT to:

Use CAPAB for any illegal activity
Post false, misleading, or fraudulent jobs or profiles
Harass, threaten, or discriminate against other users
Circumvent the platform to avoid fees (e.g., taking transactions off-platform)
Scrape, copy, or reverse-engineer the Service
Upload malicious code, viruses, or spam
Impersonate another person or entity

5. Payments and Fees

Payments between Clients and Workers are processed through Stripe.
CAPAB may charge service fees, which will be disclosed in the app.
Refund policies depend on the nature of the dispute and are evaluated case by case.
You agree to Stripe's Connected Account Agreement.

6. Worker Responsibilities

Workers are independent contractors. As a Worker, you are responsible for:

Performing services with reasonable care and skill
Carrying your own insurance where required by law
Reporting and paying your own taxes
Complying with all applicable laws and licensing requirements

7. Client Responsibilities

As a Client, you are responsible for:

Providing accurate job descriptions and locations
Paying agreed amounts on time through the platform
Treating Workers with respect
Providing a safe environment for the work

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. CAPAB DOES NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY WORKERS. CAPAB IS A PLATFORM ONLY AND IS NOT RESPONSIBLE FOR THE ACTIONS OR OMISSIONS OF WORKERS OR CLIENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPAB AND FULL MARKET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO CAPAB IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless FULL MARKET LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by emailing support@capab.app.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts of New Jersey.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app. Continued use after changes means you accept the updated Terms.
